Terms of Use
1. Acceptance of Terms
By downloading, installing, or using Fish Friendsy, you confirm that you can form a binding contract and that you accept these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
2. Beta Software
The App is currently distributed through Apple TestFlight as beta software. Features may change, be removed, or break without notice, and beta data (including catches, spots, and profile information) may be reset or lost during testing. Use the App at your own risk during this stage and avoid relying on it as your sole record of important information.
3. Accounts and Eligibility
- You must be able to form a binding contract in your jurisdiction to use the App, and the App is not directed at children under 13.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to provide accurate account and profile information.
4. Your Content
"Your Content" means catch details, notes, photos, favorite spots, and any other content you submit to the App. You retain ownership of Your Content. By submitting Your Content, you grant Fish Friendsy a limited, worldwide license to host, store, and display it back to you and to anyone you explicitly choose to share it with, solely to operate and provide the App's features.
You are responsible for Your Content and confirm that you have the rights necessary to submit it and that it does not violate any law or third party's rights.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose;
- Upload content that is harassing, defamatory, obscene, or infringes someone else's rights;
- Attempt to gain unauthorized access to other users' accounts or data, or to the App's underlying systems;
- Interfere with or disrupt the App, its servers, or its networks; or
- Reverse engineer or misuse the App outside of normal, intended personal use.
6. Location, Weather, and Safety Disclaimer
Map, location, weather, tide, and radar information in the App is provided by third-party data sources for general planning purposes only. It is not a substitute for official marine, weather, or navigation safety warnings, nautical charts, or your own judgment on the water. Always check official sources and use caution when boating or fishing.
7. Third-Party Services
The App relies on third-party services (including Firebase, Supabase, Apple, Mapbox, NOAA, weather data providers, and RainViewer) described in our Privacy Policy. We are not responsible for the accuracy, availability, or practices of these third parties.
8. In-App Purchases and Subscriptions
The App may offer optional premium features, in-app purchases, or subscriptions now or in the future. Where offered, purchases are billed and processed by Apple through your App Store account and are subject to Apple's own terms, including auto-renewal and cancellation through your Apple ID account settings. Pricing and features are described in the App at the time of purchase.
9. Termination
You may stop using the App and request account deletion at any time by contacting support@fishfriendsy.com. We may suspend or terminate access to the App if we believe you have violated these Terms or to protect the App, its users, or third parties.
10. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that weather, tide, or location data will be accurate or complete.
11. Limitation of Liability
To the maximum extent permitted by law, Fish Friendsy and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the App, even if advised of the possibility of such damages.
12. Governing Law
These Terms are governed by the laws applicable in the developer's jurisdiction, without regard to conflict-of-law principles, except where local consumer protection law requires otherwise.
13. Changes to These Terms
We may update these Terms as the App evolves, especially during beta testing. We will update the "last updated" date above when we make changes. Continuing to use the App after changes take effect means you accept the updated Terms.
